These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by REAP Technologies LLC ("REAP," "we," "us," or "our"), including getreap.ai and app.getreap.ai (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Services, you confirm that you are at least 18 years old and capable of entering into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the Services
REAP provides a real estate analytics platform that uses data and artificial intelligence to help users evaluate property and investment opportunities. The Services are provided as a software-as-a-service tool. We may add, modify, or discontinue features at our discretion.
3. Accounts and Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us promptly of any unauthorized use of your account.
- We may suspend or terminate accounts that violate these Terms.
4. Subscriptions, Billing, and Payment
- Plans and trials — REAP may offer free trials and paid subscription plans. Trial terms are described at sign-up.
- Billing — paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payments are processed by Stripe.
- Renewal — subscriptions renew automatically unless cancelled before the end of the current billing period.
- Cancellation — you may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
- Price changes — we may change subscription prices with reasonable advance notice. Changes apply to the next billing cycle.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Services, other accounts, or our systems;
- Reverse engineer, scrape, or copy the Services except as expressly permitted;
- Resell, sublicense, or commercially exploit the Services without our written consent;
- Upload malicious code or interfere with the integrity or performance of the Services;
- Use the Services to infringe the intellectual property or privacy rights of others.
6. Your Content and Data
You retain ownership of the property data, financial inputs, notes, and other content you submit to the Services ("Your Content"). You grant REAP a limited license to host, process, and display Your Content solely to provide and improve the Services. You are responsible for ensuring you have the rights to submit Your Content and that it does not violate any law or third-party right.
7. Intellectual Property
The Services — including software, design, text, graphics, and the REAP name and logo — are owned by REAP Technologies LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.
8. Analytics and No Investment Advice
The analyses, scores, projections, and insights provided by the Services are informational tools only. They are not financial, investment, legal, or tax advice. Real estate investment involves risk, and you are solely responsible for your own investment decisions. You should consult qualified professionals before making any investment.
9. Third-Party Services
The Services rely on third-party providers (including Stripe for payments, SendGrid for email, and infrastructure providers). Your use of those features may also be subject to the third party's terms. We are not responsible for the acts or omissions of third-party providers.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that data or analyses will be accurate or complete.
11. Limitation of Liability
To the maximum extent permitted by law, REAP Technologies LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the amount you paid to REAP in the twelve months preceding the claim.
12. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services ends, though certain provisions of these Terms survive termination.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
